SURABAYA - The district court in Surabaya has tried residents disobeying the smoking bylaw for the first time since it became in effect last year. Smoking in public areas has since been forbidden. One of the smokers that was convicted was disappointed about his trial, while he only had to pay 40,000 Rupiah (2.85 euro) in fines, where the maximum penalty has been set at 50 million Rupiah (3,571 euro).
"I didn't know there was such a bylaw. It's even more disappointing as I was arrested while smoking in a relative's store. The smoke was not disturbing other people," Liem told after the trial. Members of the civil police (Satpol PP) caught him smoking at the Jembatan Merah Bridge last Sunday. Two others were arrested at the same day for smoking in a shopping center. In total four packets of cigarettes were seized from the smokers.
The bylaw stipulates that shopping centers, offices and other public areas are places where smoking was only allowed in specific places. Smoking in religious places, playgrounds and educational institutes is prohibited. These regulations are almost the same as the ones currently in force in Jakarta, but enforcement has been week until now.
Owners of buildings have to put up no-smoking signs in their buildings and have to create smoking areas for those that can not withstand the pressure of not smoking for a short period. Liem added that government offices in the city did generally not provide for smoking area and thus they should be punished as well.
A spokesperson of the civil police said that enforcement of the bylaw should also create awareness about the bylaw in the city. "We will keep conducting raids in shopping centers, railway stations and places categorized as limited smoking areas," Moesaffah said. He also said that most shopping centers still did not provide special smoking rooms. Satpol PP however does not have the right to freeze licenses or such.
